What is the law in Texas regarding how many times the plaintiff gets a chance to appear in court?

This is involving a criminal case and the 'victim' has not shown in court 3 seperate times. The judge keeps giving them another chance. What happened to due process? The lawyer said is would be dismissed, but that has yet to happen!!!
