Would this "hitching post and lantern" defense work in court?

I love questions like this. Technically, since the law specifically says that the property owner will be relieved of all civil liability and it is still on the books, I think maybe it might work. On the other hand, there may be another law on the books stating that it is the property owner's responsibility to have a hitching post, which would totally open him up to liability again.
